1. PURPOSE
This document contains the legal terms governing the access, use, and registration of services provided at the website https://certiva.org/ by the Vietnam Digital Copyright Certification and Assessment Center - under the Vietnam Creative and Copyright Association (VCCA).
Note: By registering and using our services, you signify your full and unconditional acceptance of these legal terms.
- Customer/User: Any individual or organization using VCCA's services.
- Representative: Any individual registering on behalf of a third party commits that they have the legal authority to represent and bind that third party.
2. DESCRIPTION OF VCCA SERVICES
2.1. Creative Registration
This service supports recording copyright information into a digital database through:
- Creation of cryptographic fingerprints to identify the work.
- Recording the time of registration using timestamps.
- Updating registration traces onto the Blockchain for enhanced authentication.
- Issuance of digital Creative Registration Certificates.
2.2. Online Library and Content Licensing
The Author Profile service allows for the promotion and management of copyrights:
- Defining access rights (public display or restrictions on copying/downloading).
- Setting copyright licensing conditions (exclusivity, region, duration, pricing).
- Generating digital copyright certificates in PDF format for buyers.
3. ACCESS AND USE OF SERVICES
3.1. Technical Requirements
Users require a device (PC, Smartphone), stable Internet connection, and the latest browser versions. The website records access time and usage history to improve customer experience.
3.2. Account Registration and Security
- Verification: Accounts must be verified via an activation email. Unverified accounts will not be functional.
- Security: Passwords are non-transferable. Users are fully responsible for all actions occurring through their accounts.
- Refunds: Users may request a refund within 7 days of registration, provided that no services included in the package have been utilized.
4. USER OBLIGATIONS
Users commit to providing accurate, complete, and legal information. Prohibited activities include:
- Using bots or automated software to access data without authorization.
- Attacking the system or exploiting security vulnerabilities.
- Falsifying identity or registering works that infringe upon third-party rights.
Enforcement: If three (03) or more copyright complaints are received, VCCA reserves the right to terminate the user account and delete all associated records.
5. COMMITMENTS AND PRIVACY
- Storage: Files are stored under strictly confidential conditions and only provided upon legal request from competent state authorities.
- Chatbot: Do not enter sensitive personal data into the automated chatbot. VCCA is exempt from security liability in such cases.
6. FINANCE AND INTELLECTUAL PROPERTY
- Payments: Processed via third-party gateways; VCCA does not store personal payment information (card numbers, bank accounts).
- VCCA Rights: All source code, interface designs, logos, and brand identifiers are the exclusive property of VCCA.
- Work Ownership: VCCA does not certify the original ownership of works; registration serves solely to establish a verifiable timestamp.
7. LIABILITY AND GOVERNING LAW
- Limitation of Liability: VCCA's total financial liability shall not exceed the service fees paid by the user in the 12 months prior to the claim.
- Governing Law: Governed by the laws of Vietnam. Disputes shall be resolved at the competent People's Court in Hanoi.
II. REGULATION ON REGISTRATION FREQUENCY AND AUTHENTICATION
To ensure transparency, security, and quality control for all users on Certiva.org, we apply the following regulations regarding account authentication and registration frequency:
1. Account Verification Requirements
- Mandatory Identification: To register a work, users must complete login and account verification via an OTP (One-Time Password) sent to their personal phone number.
- Unique Identity Policy: Each phone number can only be linked to one (01) user account. Use of fake information or spam emails will result in automatic rejection by the system.
2. Registration Frequency Regulation (Rate Limiting)
- Minimum Time Interval: A waiting period applies between two consecutive registration requests. Specifically, each account is allowed to complete only one (01) request every 10 minutes.
- Countdown Mechanism: After a successful submission, the "Register" button will be temporarily disabled. A countdown timer will be displayed for user tracking.
- System Notifications: Requests sent before the 10-minute interval has elapsed will be rejected with a request to wait.
3. Anti-Spam Measures
IP and Account Monitoring: Certiva utilizes dual-monitoring technology based on Account ID and IP address. If abusive behavior or spamming is detected, we reserve the right to temporarily block access for that IP for 24 hours without prior notice.
